Protecting Charity Independence from Closely Connected Bodies

Recent guidelines from the Charity Commission, specifically targeted at trustees of NHS charities to protect their independence, set out principles which apply wherever a charity is closely associated with another body, whether central government, local authority, private company or funder, according to Anthony Collins Solicitors.  The consolidation of accounts has caused the Commission particular concern, leading to these guidelines clarifying what steps trustees are required to take if there is any doubt about independence.  Anthony Collins briefing, or see 'Maintaining independence' on the Commission's site, at www.charitycommission.gov.uk/supportingcharities/connhs.asp

Revised Charitable Company Registration Documents

The Charity Commission has released a new model Memorandum and Articles of Association (GD1) for charitable companies, revised to meet requirements of the Companies Act 2006 for registrations from 1 October.  Some background information at www.charitycommission.gov.uk/registration/gd1new.asp or go to the Model Governing Documents page at www.charitycommission.gov.uk/registration/mgds.asp

Progress on New Legal Form for Charities Inches Forward

The Office of the Third Sector has published the results of its consultation on the Charitable Incorporated Organisation, a new form of legal body which will see charitable companies (in England and Wales) being formed which only have to report to the Charity Commission, and not Companies House as well.  It is hoped that this model will be available from spring 2010, although it has been pointed out that due to financial restraints (and the costs to the Charity Commission), the ability for existing charitable companies to convert may be delayed.  Official news item.

Governance Pages has a brief overview on what changes have been made as a result of the consultation, at www.governancepages.org.uk/Newsletters/newsletter13  Existing legal models will continue to be available.

Considering Collaboration and Merger to Protect and Promote Services

The Charity Commission, the regulator of charities in England and Wales, has published two toolkits giving a clear framework for charities to decide whether collaborative working or merging would help them and their beneficiaries.  It has also released research that less than a tenth of charities have considered collaborating, forming a consortium or merging with other charities in response to the economic downturn, although charities with an income at least a million pounds have a slightly stronger record.

Arguing for Sector Support in Leaner Times

A recent speech by Stephen Bubb, chief executive of the umbrella body for charity bosses ACEVO, 'The Future of Capacity Building' gives some thought to support structures for the voluntary sector given upcoming financial restraints.

Citizen Influence on Delivery of Local Services

'WeCan!' is a quarterly magazine for people interested in getting involved in and influencing the delivery of services in their local area, produced by Communities and Local Government Department.  It "shows how government is working with organisations and networks at national, local and regional levels to support initiatives that help citizens shape the places they live in, and the services they use and enjoy.”

Getting the Right Group Name on Social Networking Sites

From Nonprofit Tech 2.0 website: "Like clockwork, every couple of weeks I receive an email from a panicked nonprofit or university asking how they should handle a situation where someone has squatted their URL/username on a social networking site.  ....  Sometimes these squatters actually have the audacity to ask for money.”  Some advice at nonprofitorgs.wordpress.com/2009/09/13/socialmediasquatters/
