Managing Capability with the Fit Note

NCVO Employment Practice Network
What kinds of tasks are suitable for people, after they’ve been off work? How do you make a “reasonable” adjustment to working arrangements? How does the fit note work?
Free
Lin Hinson from HR Solicitor will take you through the nuts and bolts of managing capability using the fit note. You will cover the note’s key features and implications - and how to effectively incorporate it into your absence management process.
This session includes:
- Sick note and fit note: understanding what’s changed
- The tribunals’ view of “reasonable adjustments”
- The stages to consider when helping an employee back to work
- Tools and checks to help you fulfil your duties as an employer
- What to update in your HR policies and procedures.
There will be opportunity to apply the principles and use the tools in practice through case studies and group work.

Derbyshire Dales & High Peak Joint Core Strategy Draft Plan Consultation
3 June to 15 July 2010
Derbyshire Dales District Council and High Peak Borough Council are preparing a new plan for the area, known as the Core Strategy, to set out plans for the future growth of the towns and villages across the plan area to 2026.
The purpose of the consultation is to allow residents, businesses and key stakeholders the opportunity to comment upon how the Core Strategy is being taken forward in terms of the policies proposed and whether it is the most appropriate approach.
To enable you to make a fully informed and timely response a series of public exhibitions and meetings are to be held by High Peak Borough Council in the following locations:
3 June to 15 July Gamesley, Chapel-en-le-Frith, Whaley Bridge and New Mills Library; Buxton Pavilion Gardens and High Peak Borough Council Offices at Glossop, Chinley and Buxton
17 June to 10 July Glossop Library
28 June to 15 July Buxton Library

Effective Dispute Resolution Tactics
Expert advice from Compact Advocacy: Fighting the Good Fight
Despite best intentions, disputes arise and sometimes threaten important partnerships. Follow the top tips below on how to best resolve disputes
- Keep your own house in order – you have a better chance of settling a dispute successfully if you make sure you abide by funding agreements, honour your Compact commitments and fulfil financial obligations. This includes sending reports on time and keeping a written record of all communication with public bodies.
- Prevention is better than cure – if you have concerns around your funding or relationship with a public body, don’t wait for it to turn into a problem. Read your local Compact and open up a dialogue. If you can engage them constructively before something really becomes an issue, you’ll have a better chance of getting it solved.
- Challenge early – the longer time that elapses after a decision has been made, the harder it will be to reverse it. In cases of Public Law breaches, a challenge has to be brought to court promptly and in any case no more than three months after the decision was taken.
- Be clear about your objectives – know what you are unhappy about and what you want to achieve. Keep it as straightforward as possible, and try to be realistic.
- Keep it professional – although emotions can run high, you are more likely to achieve what you want if your organisation is viewed as professional, effective and good to work with.
- Consider all your options – every organisation has the right to their independence and to manage their own affairs, but some are reluctant to be seen to confront their funder. It may be that you can raise the issues through your Compact group, or perhaps there’s an appeal process or complaint procedure that you can use. Think about what would be best for your organisation and beneficiaries.
- Get help – it is useful to get an outsider’s perspective on the dispute. Contact Empowering the Voluntary Sector and we can help you identify Compact or Public Law breaches, suggest next steps, help draft letters, attend meetings and sometimes take on your case, advocating on your behalf.

Peak District Planning Help
A new free service to help people with questions about planning in and around the Peak District is launched this week. Friends of the Peak District’s Planning Help aims to give clear, impartial information and advice to local people about planning applications that could affect their local countryside.
Recent example of developments that Friends of the Peak District has helped to oppose include: quarrying near the Nine Ladies circle on Stanton Moor and the new bottling factory at Cowdale near Buxton. But Friends of the Peak District has also supported planning applications for affordable housing and green energy projects.
The service covers all the Peak District National Park, plus High Peak and the six North East Derbyshire parishes of Barlow, Dronfield, Eckington, Holmesfield, Killamarsh and Unstone.

Changes in Allocation of National Lottery Funds
The new government proposes to change to the share of money allocated from the National Lottery. Each of the arts, heritage and sport good causes would increase to 20 per cent, with the Big Lottery Fund receiving the remaining 40 per cent and focusing its support exclusively on the voluntary and community sectors.

Stephen Lloyd, a senior partner at solicitors Bates Wells and Braithwaite, has also expressed concern that budget cuts had already affected the Charity Commission's ability to implement the 2006 Charities Act, predicting that the charitable incorporated organisation legal form would become a "fossil in the legislation".
